The Types of Cases We Handle

Personal Injury and Wrongful Death

We represent clients and families in almost every type of injury that can occur, including (but not limited to):

If you have been injured, or if a family member has died, as the result of the wrongful, negligent, or intentionally reckless actions of another, we invite you to contact us.

Our Fees – We accept injury and wrongful death cases on a contingency fee basis, meaning that there are no fees unless compensation is recovered. We additionally advance litigation costs; these expenses are normally repaid to the firm from compensation received from a settlement or jury award. We believe that your focus should be on healing, not on worrying about how you are going to pay litigation costs (especially if you are unable to work).

Social Security Disability

If you’ve become disabled and cannot work, we can help you file for the social security disability income (“SSDI”) benefits from the Social Security Administration (the “SSA”). We can also represent you in the appeals process if your claim was rejected.

When we learn about your case, we can explain what is needed to qualify for SSDI benefits. If you do not meet the work eligibility requirements but nonetheless meet certain asset requirements, you may be eligible to receive what is known as Supplemental Security Income (“SSI”) benefits.

Our Fees – Federal law dictates the maximum amount that attorneys can charge in Social Security Disability (“SSD”) cases. Normally, this amount is capped at 25% of the back pay amount or $9,200 (whichever is less).[1] We do not receive any fee for social disability payments that do not become due until after the initial award. As a result, if we are retained at the outset of a case, in most cases our fee will be significantly less than if we are retained at a later date as the “back pay” amount will be much less.

Educated at Duke University, I graduated with honors in the top 10% of his law school class, I have earned a reputation for having a results-driven approach, being a dedicated litigator who knows how to obtain full and fair settlements and maximum jury verdicts for injury clients.

Why Should I Hire The Mark Hurt Law Firm?

Mark Hurt is a nationally-recognized attorney with extensive trial experience, including trying cases before juries and successfully arguing appeals in Virginia, Tennessee, and the federal courts. Mark has the rare distinction of being one of the less than 1% of lawyers who have argued before our nation’s highest court, the United States Supreme Court (where he argued two cases).

With over thirty years of legal practice, Mark is a veteran attorney who has won or obtained through settlement millions of dollars in compensation in court and before juries in personal injury cases. Opposing lawyers in injury cases know about our reputation for success and vigorous client representation, and that if a full and fair settlement is not forthcoming, Mark will not hesitate to take a case to trial.

    FAQ

We are dedicated to provide full-service representation and attention to all our clients. Find expert responses to our clients’ most frequent legal questions.

    Personal Injury

Tennessee’s statute of limitations for most personal injury claims is just one year from the date of the injury, which is shorter than many neighboring states. It’s important to contact an attorney quickly so evidence can be gathered and your claim can be filed on time.

Tennessee follows a modified comparative fault rule. You can still recover compensation if you are less than 50% at fault, but your recovery is reduced by your percentage of fault. An experienced attorney can work to minimize the fault attributed to you.

Depending on your case, you may be able to recover medical expenses, lost wages, future lost earning capacity, pain and suffering, and property damage. Serious or permanent injuries may also support claims for future medical care and diminished quality of life. Some categories of damages may be subject to legal limits, so it is important to discuss the specifics of your case with an attorney.

    Social Security Disability

Initial decisions often take several months. If your claim is denied and proceeds to a hearing before an administrative law judge, the wait can extend well beyond a year depending on current caseloads. Filing a complete, well-supported application from the start can help avoid unnecessary delays.

Many claims are denied at the initial application stage, but that does not mean your case is over. You may be able to appeal through reconsideration and, if necessary, request a hearing where an attorney can present your medical records and testimony to an administrative law judge.

You can work, but your earnings generally cannot exceed the SSA’s substantial gainful activity limit, or it may affect your eligibility. If you are unsure whether part-time work could impact your claim, it is worth discussing your specific situation with an attorney before you apply.
